Agreement to Terms

By accessing or using Oriental Aesthetics Portrait Studio ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms constitute a legally binding agreement between you and Oriental Aesthetics Portrait Studio ("we," "our," or "us").

Service Description

Oriental Aesthetics Portrait Studio is an AI-powered service that transforms photos into artistic portraits inspired by traditional East Asian art styles. We use artificial intelligence and machine learning algorithms to generate stylized images based on user uploads. The Service is provided "as is" and we make no guarantees about the quality, accuracy, or suitability of generated images for any particular purpose.

Eligibility

To use our Service, you must:

• Be at least 16 years of age
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information
• Maintain the security of your account credentials

By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to terminate accounts that violate these requirements.

Account Registration and Security

When you create an account, you must provide accurate and complete information. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach. We cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.

Acceptable Use Policy

Prohibited Content

You may not use the Service to generate, upload, or distribute:

• Content depicting minors in inappropriate or exploitative contexts
• Sexually explicit, pornographic, or obscene content
• Violent, hateful, or discriminatory content targeting individuals or groups
• Content promoting illegal activities or terrorism
• Content that infringes on intellectual property rights
• Deepfakes or synthetic media intended to deceive or defame
• Private information of others without consent
• Malware, viruses, or harmful code

Prohibited Activities

You agree not to:

• Use automated means (bots, scripts) to access or use the Service
• Attempt to circumvent usage limits or security measures
• Reverse engineer, decompile, or disassemble the Service
• Interfere with or disrupt the Service or servers
• Harvest or collect user information without consent
• Resell, redistribute, or commercially exploit the Service without authorization
• Upload photos of individuals without their consent

Intellectual Property

Your Content

You retain ownership of photos you upload to the Service. By uploading content, you grant us a limited, non-exclusive, royalty-free license to use, reproduce, and modify your photos solely for the purpose of providing and improving the Service. This license terminates when you delete your content or account.

Generated Images

Subject to your compliance with these Terms and applicable law, you are granted a personal, non-exclusive, worldwide, royalty-free license to use generated images for personal, non-commercial purposes. For commercial use, you must purchase appropriate credits or a commercial license. We retain ownership of the AI models and the technology used to generate images.

Service Content

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of our content without express written permission.

Credits and Payments

Credit System

The Service operates on a credit-based system:

• Free users receive daily credits that reset every 24 hours
• Purchased credits do not expire but are non-refundable
• Each image generation consumes one credit
• Failed generations due to service errors are credited back automatically
• Credits have no cash value and cannot be transferred between accounts

Payments and Refunds

All payments are processed through third-party payment providers. Prices are displayed in USD and may be subject to taxes. By making a purchase, you agree to the pricing and payment terms. All sales are final except where required by law. Refund requests are considered on a case-by-case basis for technical failures preventing service use.

Subscription Terms

If you subscribe to a paid plan:

• Subscriptions automatically renew unless cancelled
• You can cancel at any time from your account settings
• Cancellation takes effect at the end of the current billing period
• No partial refunds for unused subscription periods
• We reserve the right to modify subscription terms with 30 days notice

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT GENERATED IMAGES WILL MEET YOUR EXPECTATIONS OR BE SUITABLE FOR ANY PURPOSE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to defend, indemnify, and hold harmless Oriental Aesthetics Portrait Studio and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) your content or generated images.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the new terms, please stop using the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the jurisdiction of such courts.

Dispute Resolution

Before filing any claim against us, you agree to try to resolve the dispute informally by contacting us. We'll try to resolve the dispute informally. If a dispute is not resolved within 30 days, any legal action must be commenced within one year after the claim arose. Both parties waive the right to a jury trial and the right to participate in a class action.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede any prior agreements.
